Terms & Conditions
1. These terms and conditions regulate the participation of the participants in the Gabriele Frantzen x Seidensticker giveaway of Seidensticker GmbH, Am Stadtholz 39, 33609 Bielefeld, Germany (hereinafter referred to as the "Promoter").
2. The Gabriele Frantzen x Seidensticker giveaway is not associated with Instagram and is in no way sponsored, supported or organised by Instagram. The recipient of the information provided by the participant is not Instagram, but the organiser as the operator of the Instagram account @seidensticker_com.
3. The competition has the following start and end dates: 10.12.2024 at 12:00 am (Closing date)
4. The giveaway is only available online at https://www.instagram.com/seidensticker_com/.
5. Participation in the competition is voluntary, free of charge and subject to the conditions set out in section 6. Participation is not linked to any obligation to purchase. Participants must only bear the costs associated with participating via the Internet (usage fee for Internet connection).
6. The competition is open to all natural persons who are at least 18 years of age and resident in Germany, Austria or Switzerland, who follow the Instagram account @seidensticker_com https://www.instagram.com/seidensticker_com/ or the account https://www.instagram.com/gabrielefrantzen, like the competition post, leave a comment with a heart emoji and tag two other people who are active on Instagram and who are also at least 18 years of age and resident in Germany, Austria or Switzerland. Employees of the Promoter as well as their family members are excluded from participation in the competition. Participation is not restricted to customers of the Promoter.
7. The following item from the Gabriele Frantzen x Seidensticker Autumn/Winter 2024 collection will be raffled: Art. 60.636931-0020, Scarf in Alpaka blend (RRP 149.99€)
8. The winner will be drawn from all eligible participants within 48 hours of the closing date.
9. The winner will be drawn from all eligible participants within 48 hours of the closing date. The winner will be contacted via the Instagram account used to enter the competition.
10. The winner must respond to the winning notification via direct message on Instagram within three days of it being sent, in order to claim the prize. Failure to do so will result in forfeiture of the prize and an alternate winner will be drawn in the same manner.
11. The won product can be redeemed as follows: The winner responds by email () or Instagram direct message to @seidensticker_com by the date below.
12. If the winner registers via Instagram direct message or email, he/she will continue to be contacted by the Promoter via the aforementioned media in order to process the prize. There is no obligation to accept the prize.
13. Latest Expiration Date: 13.12.2024 at 14:00 hrs
14. The Promoter reserves the right, at its sole discretion, to disqualify any person for good cause, including but not limited to (a) tampering with the entry process or the operation of the Competition, (b) breaches of these Competition Rules, (c) unethical behaviour, or (d) providing false or misleading information in connection with participation in the Competition.
15. Entries that are late, incomplete or otherwise do not comply with these terms and conditions will not be accepted. Entries submitted through intermediaries, third parties, organised groups or other methods of entry duplication will not be accepted.
16. If a Participant's capacity to contract is restricted, the consent of his or her legal representative is required.
17. The entrant is responsible for the accuracy and completeness of the information provided.
18. The prize cannot be exchanged or paid out in cash and is non-transferable.
19. The winner is responsible for any tax due on the prize.
20. The organisers point out that the availability and functioning of the competition cannot be guaranteed. The competition may be
terminated, extended or cancelled due to external circumstances or compulsions, without this giving rise to any claims on the part of the participants against the organisers.
21. The right of recourse is excluded.
22. Salvatory clause: If any provision of these Terms and Conditions is or becomes invalid or unenforceable in whole or in part, the remainder of these Terms and Conditions shall remain in full force and effect. The ineffective provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the ineffective provision. The same applies for the case of a loophole in these Terms and Conditions.
23. The Promoter's competition is subject to German law, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from these terms and conditions is the Promoter's registered office in Bielefeld, Germany, unless the Participant is a merchant or has a general place of jurisdiction in the Federal Republic of Germany.
24. The following exclusions and limitations of liability shall apply to any liability of the Organisers for damages, without prejudice to the statutory requirements: The Organisers shall be liable without limitation if the cause of the damage is based on intent or gross negligence. Furthermore, the Organisers are liable for the slightly negligent breach of material obligations, the breach of which jeopardises the achievement of the purpose of the contract, or for the breach of obligations the fulfilment of which makes the proper execution of the raffle possible in the first place and on the observance of which the contractual partners regularly rely. In this case, however, the Organisers shall only be liable for the foreseeable, contractually typical damage. The Organisers shall not be liable for any slightly negligent breach of obligations other than those referred to in the preceding paragraphs. The foregoing limitations of liability shall not apply in the event of injury to life, body or health, in the event of a defect after the assumption of a guarantee for the quality of a product or in the event of defects which have been fraudulently concealed. Liability under the Product Liability Act remains unaffected. To the extent that the Organisers' liability is excluded or limited, this shall also apply to the personal liability of the Organisers' employees, representatives and vicarious agents.
25. The right of appeal is excluded
26. By participating, the entrant expressly accepts these terms and conditions. Multiple entries are possible under the conditions stated in the respective entry.
27. Privacy Notice
The Promoter will collect and use the data of the Participants only to the extent permitted by law and with the consent of the Participants. The personal data collected by the organisers from the participant(s) in the course of the competition (name, email address, postal address) will be used to run the competition and, in the event of a win, to send further written information. The recipient of the information provided by the participant is not Instagram, but Seidensticker GmbH as the operator of the official Instagram page @seidensticker_com. Participants in the competition agree that their personal data, namely first name, surname, email address and postal address, may be passed on to the shipping company commissioned to deliver the prize. The data will not be passed on to third parties. Entrants' personal data will only be stored for the duration of the competition. You can object to the further use of your data for this purpose at any time. Your objection should be sent to presse@seidensticker.de. In addition, the data protection regulations of Seidensticker GmbH apply.
